The Post Transaction Management Department is charged with the responsibility of monitoring and enforcing compliance with the covenants as stipulated in the Share Sales Purchase Agreement (SSPA) by the investors as well as proposing strategic direction for the resuscitation of non-performing enterprises.

The Department is made up of three (3) core Units, namely:

  1. Labour Unit
  2. Impact Assessment Unit
  3. Monitoring, Evaluation & Delisting Unit

Other functions of the Department includes:

  • Monitoring and enforcement of compliance by investors in fulfilling the covenants as stipulated in the Share Sales Purchase Agreement (SSPA).
  • Enforcement of full compliance with the covenants, including the implementation of the approved Post Acquisition Plans (PAPs), especially in the areas of new capital investments, capital markets participation, execution of development plans, employment generation and other matters, compliance with safety, health and environmental requirements, etc.
  • Assessment of how privatisation has impacted on the privatised enterprises and the national economy generally and conduct post transaction studies in collaboration with the Strategic Planning Unit of the Bureau.
  • Collating, maintaining and securing all relevant records as regards the Bureau’s concluded transactions.
  • Providing timely reports on the investors’ compliance with covenants, as stipulated in the Share Sales Purchase Agreement (SSPA) and Post Acquisition Plans.
  • Routinely carrying out an assessment of how privatisation has impacted privatised enterprises and the national economy in general.
  • Ensuring that complete and timely information are provided on Post-transaction issues, when required.
  • Promoting constructive and continuous dialogue between workers and the managements of privatised enterprises and those slated for reform.
  • Addressing all outstanding labour issues in privatised enterprises regarding redundancies, pension buyouts, etc.
  • Undertaking due diligence studies, to ascertain causes of operational challenges in non-performing enterprises.
  • Articulating strategic roadmaps for the resuscitation of non-performing enterprises.
